Tickets Issued on Major Highways and Road across TexasPlease read these terms of use carefully as they contain important information regarding your legal rights, remedies and obligations. By accessing or using the site and the services, you are entering into a legal contract with Premier Defensive Driving, LLC, the terms of which govern your use of the site and services. Accordingly, by your access or use, you agree to be bound by the terms and conditions described herein and all additional terms incorporated by reference. If you do not agree to all of these terms, do not use the site or the services.

By using the service, you acknowledge that you have been furnished the school tuition schedule, cancellation and refund policy, school regulations, grading policy, progress and rules of operation. If you have not received any of this information, please advise Premier Defensive Driving, LLC, and we will provide it to you immediately.

The following are the terms of use between you (STUDENT) and Premier Defensive Driving, LLC:

Charges and Terms of Payment:

To register and enroll in the course, the student must pay a fee of $25. The fee may be paid by credit card, debit card, electronic check, cash, check or money order and must be paid prior to course completion. This fee includes full access to course instructional materials, unit testing and verification, a Certificate of Completion upon successful completion of the course and the electronic delivery of said certificate via email. Premier Defensive Driving, LLC also offers Certified Driving Records and regular and express mail delivery options for additional fees.

Course Time Management:

Premier Defensive Driving, LLC, offers a course composed of 11 sections spanning a total of 6 hours (including 60 minutes of break time).

The course will be available to the STUDENT 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site or connectivity failure over which the Premier Defensive Driving, LLC has no control.

Sixty minutes of time, exclusive of the 300 minutes of instruction, shall be dedicated to break periods. All break periods shall be provided after instruction has begun and before the completion of the course.

Course Name and Instructor:

Juan Hernandez is the named instructor for this course.

Internet, Hardware, and Software Requirements:

Internet connectivity is required to access the site and services, including taking the course. Minimum browser requirements are the use of Microsoft Internet Explorer (MSIE) 9.0 or greater, or any other browsers that provide equal or greater functionality such as Mozilla Firefox, Google Chrome, or Safari. In addition, the browser must be equipped with Macromedia Flash Player 9.0 or greater. This plugin is entirely free and is made available on http://www.adobe.com for download and installation. The course requires the use of a pointing device such as a mouse. The course recommends that the hardware be equipped with an audio output, such as speakers or headphones.

Completion and Certification Policy:

The STUDENT agrees to complete all phases of the approved curriculum in order to receive a Certificate of Completion. Premier Defensive Driving, LLC is prohibited from issuing a Certificate of Completion if the student has not met all of the requirements for course completion and the student should not accept a Certificate of Completion under such circumstances.

Premier Defensive Driving, LLC will email the Certificate of Completion immediately after successful completion of the course, receipt of payment and receipt of notarized Statement of Assurance (if required). The STUDENT’S Certificate of Completion will also be available for download directly under their profile page at that time. If the STUDENT selects physical delivery of the Certificate of Completion by mail, Premier Defensive Driving, LLC will issue the Certificate within 24 hours of course completion.

The fee for a duplicate Certificate of Completion is $10. If the STUDENT requests a duplicate within 30 days of the date of the original certificate because the original was not received, was damaged so as to be unusable or was issued with errors due to no fault of the STUDENT, Premier Defensive Driving, LLC shall issue the duplicate at no cost to the STUDENT. Duplicate certificates must be requested directly from Premier Defensive Driving, LLC.

Premier Defensive Driving, LLC may terminate, without notice, the enrollment of any student who has not successfully completed the course within 120 days from the date of registration. Additional fees may apply to continue a course after the initial 120 days has lapsed, or the student may be required to register as a new student.

Grading and Progress:

The STUDENT understands that he/she may not be given credit for the course unless the STUDENT passes the quiz contained in each of the sections of the course, excluding the introductory section. Each section will incorporate a quiz consisting of four questions drawn from the instruction material. In order to pass, the STUDENT must correctly answer at least three of the four questions. The STUDENT will be allowed 3 attempts to pass each unit quiz. If the STUDENT does not initially pass, the STUDENT will be allowed to review the instructional material, if necessary. If the student fails a section quiz on the third attempt, he/she will fail the course. The STUDENT must obtain a cumulative score of 70% or higher in order to pass this course.

Personal Validation:

Premier Defensive Driving, LLC shall include ten (10) personal validation questions throughout the course in order to validate the personal identity of the STUDENT. In the event the STUDENT is unable to provide the correct answer on four (4) separate validation questions, he/she will be logged out of the course and may be reinstated only by the course administrator, in compliance with TDLR regulations. The STUDENT shall have 90 seconds to respond to each question. A combination of four (4) validation attempts resulting from either: failure to respond correctly or failure to respond within the 90-second time, shall result in authentication failure.

In the event information pertaining to the STUDENT cannot be retrieved from the databases, the STUDENT must submit to Premier Defensive Driving, LLC a notarized Statement of Assurance (Student Affidavit) certifying that the individual attended and successfully completed the six-hour driving safety course for which the certificate is being issued. If a Statement of Assurance is required, the STUDENT’S course will be deemed completed only upon receipt by Premier Defensive Driving, LLC of the STUDENT’S notarized Statement of Assurance.

Circumvention Warning:

The STUDENT agrees that HE/SHE, and not any other person, will study the material in its entirety and complete the chapter quizzes. It is illegal to attempt to circumvent this online state-licensed course or provide false information. If Premier Defensive Driving, LLC discovers that the STUDENT has willfully misrepresented himself or has cheated, the STUDENT will be stopped from taking the course with no refund of the registration fees. In addition, the STUDENT may be prosecuted for perjury and other criminal acts which are punishable by law.

Cancellation and Refund Policy:

A full refund will be made to the STUDENT if cancellation notice is made available in writing to Premier Defensive Driving, LLC within 30 days of registering for the course and prior to completion of course. If the student has not successfully completed the course within 120 days, his/her registration will be terminated, and the student will not be eligible for a refund.

All registration fees paid are due and refundable when the course of instruction is discontinued by Premier Defensive Driving, LLC, preventing the student from completing the course. Any refund will be made within 30 days of the effective date of termination.

Privacy Policy:

This privacy policy governs the information collection practices of the Premier Defensive Driving, LLC. The policy below explains how we collect and use the personal information you provide us.

Premier Defensive Driving, LLC recognizes the importance of protecting your personal information and we are committed to safeguarding your personal information. We will not collect personally identifying information about you except when you specifically and knowingly provide it. We also take reasonable precautions to protect your personal information.

Premier Defensive Driving, LLC is the sole owner of the information collected. We may collect information (including, name, address, driver’s license number, email, and phone number), personally identifiable information (including, driver’s license number, SSN, DPS audit number, citation number, county and state information), and demographic information (including zip code, date of birth, or gender). We will not use or sell this information to promote products or services or in ways different from what are disclosed in this statement. We will deny requests for marketing, scholastic, demographic, or other information requests from entities that could derive commercial or social benefits from such data. We do not sell or rent our mailing lists.

The personal information we collect is used to help us better serve your needs, such as through the provision of services or information that may be of interest to you.

Our privacy policy covers Premier Defensive Driving, LLC’s treatment of personally identifiable information that we collect when you are on the website and when you use our services. Personally identifiable information includes, but is not limited to, first and last name, physical address, zip code, email address, phone number, social security number, birth date, credit card information, financial information, and other sensitive information necessary to provide the associated services. If, however, we are required by law to comply with a valid legal requirement such as law, federal regulation, search warrant, subpoena or court order, we may be required to release personal information.

Security Policy:

Premier Defensive Driving will take extreme care in protecting STUDENT information, especially financial and personal information in transit and at rest. STUDENT information collected in the classroom may be handled only by the instructor teaching the particular course in which the data was collected.

The information is to be used as needed for payment processing or for state reporting purposes. Once the STUDENT information has been used for its required purpose, the documents will be securely stored for future reference / audits inside Premier Defensive Driving’s main office inside of a storage cabinet which is to remain locked at all times unless it is being used to retrieve or store files.

Credit card information retained by Premier Defensive Driving, LLC is processed only through SSL encryption and STUDENT data is secured in a similar fashion, with only course representatives having access to the STUDENT’S personal details.

Third-Party Data for Internet use:

STUDENT understands that for STUDENT validation purposes, Premier Defensive Driving, LLC will access public databases from third party sources in order to extract driver’s license and vehicle registration information. The STUDENT authorizes Premier Defensive Driving, LLC to access this information under the condition that it be used exclusively for the purpose of STUDENT validation.

Limitation of Liability:

The STUDENT acknowledges and agrees that the liability of Premier Defensive Driving, LLC and their agents and employees for any act, omission to act, or negligence on the part of Premier Defensive Driving, LLC and their agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by STUDENT.

This agreement constitutes the entire contract between Premier Defensive Driving, LLC and the STUDENT, and any oral assurances or promises not contained herein shall not bind Premier Defensive Driving, LLC or the STUDENT. If any provision of this agreement is found by a court of competent jurisdiction to be unenforceable, the remaining terms and conditions shall nevertheless be of full force and effect.

The STUDENT further realizes that any grievances not resolved by the school may be forwarded to Premier Defensive Driving, LLC (1200 Smith Street, Suite 1600, Houston, Tx 77002) and to the Texas Department of Licensing and Regulation, Driver Education and Safety, Austin, Texas 78701 (512-463-6599).

Survey Submissions:

After completion of the course, Premier Defensive Driving, LLC may request information from the STUDENT via a survey. Participation in the survey is completely voluntary and the STUDENT can skip the survey page. Survey information will be used for purposes of monitoring or improving the use and satisfaction of our site and for statistical purposes.

Cancellation Policy

A full refund will be made to the STUDENT if cancellation notice is made available in writing to Premier Defensive Driving, LLC within 30 days of registering for the course and prior to completion of course. If the student has not successfully completed the course within 120 days, his/her registration will be terminated, and the student will not be eligible for a refund.
